NATIONAL ORIGIN DISCRIMINATION
It is illegal to discriminate in the terms or conditions of employment on the basis of a person’s national origin. This includes, discrimination in pay, title, hours, vacations, and most everything else, including whether or not a person is hired, terminated, or promoted. It is also illegal to discriminate based on association with people of a particular national origin.
There are two types of national origin discrimination in the workplace: “disparate treatment” and “disparate impact”. “Disparate treatment” is simple discrimination. For example, treating a person differently because of a protected class, like national origin, religion, sex or race. Disparate Impact Discrimination the company policy excludes certain individuals from certain jobs, positions, or from promotions. This is the case even if the policy was not actually designed to exclude these individuals, but nevertheless resulted in that outcome.
